Terms of Service

1. About Theirs & Ours
Theirs & Ours is a service operated by Theirs & Ours Pte Ltd, a private limited company incorporated in Singapore. We help people produce hardcover books of photos and memories about someone they care for — typically a milestone birthday, a leaving or retirement, or a person who has died.
In this document, “we”, “us”, and “our” mean Theirs & Ours Pte Ltd. “You” means the person who has agreed to these terms by creating an account or paying for a book.
2. Who can use the service
You must be 18 years old or older and have the legal capacity to enter into a contract to use the service. Contributors who add memories to a book at your invitation are not required to create an account, but by contributing they agree to the relevant parts of these terms and to the consent statement shown to them at the time of submission.
3. Your content
You retain ownership of every photo, recording, written memory, and other content you or your invited contributors upload to a book.
By submitting content, you grant Theirs & Ours a non-exclusive, worldwide licence to store, process, format, print, and deliver the content for the purpose of producing the book you have ordered, and to make it visible on a digital board where the product you have chosen includes a digital board. This licence ends when your account is closed or you instruct us to delete the content, whichever is sooner — except where retention is required to satisfy a legal obligation or to maintain records of past fulfilment.
We do not use your content to train AI models. We do not sell your content. We do not show your content to anyone outside the people you have invited to view the book or board.
4. Payment
We charge for books in the currency shown at checkout. Prices include applicable consumption taxes (UK VAT, Singapore GST, EU VAT, or local equivalents) where we are required to collect them. Payment is processed by Stripe, our payment provider. We do not store card details on our own systems.
5. Refunds
Because each book is printed to order, we cannot offer refunds once the print order has been placed with our print partner. You may cancel and request a full refund at any point before the print order is placed.
For digital products and add-ons (where applicable), cancellation is available at any point before they are produced or delivered.
If a printed book arrives damaged, faulty, or significantly different from what you ordered, we will replace it at our cost.
6. Acceptable use
You may not use the service to produce or share content that:
- infringes the intellectual property rights of others;
- contains illegal material, including child sexual abuse material, incitement to violence, or material that violates applicable hate speech laws;
- depicts another living person without their reasonable consent;
- is intended to harass, defame, threaten, or harm another person.
We reserve the right to refuse to print or display a book that violates these terms, and to remove offending content from any digital surface we operate.
7. Memorial use
Memorial books and boards involve content about a deceased person. By creating a memorial board or book, you confirm that:
- you have a legitimate relationship to the deceased person (family member, close friend, or appointed representative);
- you have informed contributors that their content will be included in a printed book and, where applicable, displayed on a board accessible to anyone with the share link;
- you have a process for handling takedown requests from contributors who later change their mind.
We will action takedown of contributor content on request from the contributor themselves, the buyer of the board or book, or a person with legitimate standing to act on behalf of the deceased person.
8. Termination
You may close your account at any time by contacting us. We will delete your account data, except where retention is required to satisfy a legal obligation (for example, retaining records of past transactions for tax purposes — typically up to seven years).
We may terminate your account if you materially breach these terms or fail to pay for a book you have ordered. We will give you notice and a reasonable opportunity to address the issue before terminating.
9. Liability
To the extent permitted by law:
- our liability to you for any claim arising from your use of the service is limited to the amount you have paid us in the twelve months preceding the claim;
- we are not liable for indirect, consequential, or incidental losses;
- nothing in these terms excludes liability we cannot exclude under applicable consumer protection law.
10. Governing law
These terms are governed by the law of Singapore. Disputes will be heard in the courts of Singapore, except where local consumer protection law in your country of residence grants you additional rights to bring claims in your own country.
